A 34-year-old Waukesha stepfather has been accused of allegedly drugging and molesting his 15-year-old stepdaughter on numerous occasions and inappropriately touching her friend during a sleepover on Saturday, March 23.

The man, who will not be identified to protect the identity of the alleged victims, was charged on March 26 in Waukesha County Circuit Court with repeated sexual assault of a child, second degree sexual assault of a child, and two counts of contributing to the delinquency of a child.

At an initial court appearance on March 26, Judge William Domina set the man’s cash bond at $100,000. The man was ordered to not have any contact with the victims listed in the complaint or their residence and was not to have unsupervised contact with any child under the age of 18.

If convicted on all counts, the man could face over 80 years in prison, $200,000 in fines, or both.

According to the criminal complaint:

City of Waukesha Police were dispatched on March 25 to the stepfather’s residence on Pewaukee Road, located just north of the Waukesha County Courthouse, to investigate a sexual assault reported by the parent’s of a 15-year-old girl.

The girl, a friend of the man’s stepdaughter, told police she spent the night of March 22 at her friend’s house. Another girl spent the night. The man had provided the girls with alcoholic lemonade and his stepdaughter drank a lot, her friend said, and started throwing up.

Her stepfather told her to go upstairs and they were up there for a long time, the friend told police. She went up to check on her friend and found the girl in her stepfather’s bed, with him trying to quiet her.

The stepfather offered marijuana to the girls, and they all smoked. He then gave his stepdaughter sleeping pills, telling her, “…they would help get her high,” the complaint reads. She did not want to take them, her friend said, but eventually took three of them.

The girl told police she went downstairs and the man allegedly kept touching her inappropriately and turning her chair to face him. She told police she was, “freaked out.”

She said she went down to the basement bedroom and locked the door. She late woke up to the man allegedly rubbing against her and touching her inappropriately.

The girl said she also spent the night of March 23 at the house, and again the stepfather provided marijuana. They also snorted some stimulant medication provided to the girl. Sometime later, the man’s stepdaughter passed out and again the man allegedly began touching the girl’s hips and breasts. She got away and called her brother to pick her up.

Police spoke to the man, who admitted he gave alcohol and marijuana to the girls and muscle relaxers to his stepdaughter. He said he took his stepdaughter up to his room after she became drunk and undressed her because she had spilled water on her clothes. He denied touching the girl, but told police that about a year ago, his stepdaughter touched his penis.

He said that he had performed oral sex on his stepdaughter on five separate occasions in the previous year, claiming he did not penetrate her because pain medication he took for a back problem rendered him impotent.

He said he had performed oral sex on his stepdaughter most recently in February. He also told police he had digitally penetrated his stepdaughter and fondled her breasts.

Police spoke to the man’s stepdaughter, who said that her stepfather had told her he had sex contact with her on multiple occasions, but similar to the night of March 23, she was always under the influence and had difficulty remembering what happened.

She said that on March 23, she woke up in her stepfather’s bed naked, her clothes strewn about the room. She said her body felt sore and there was a wet spot on the bed. Her stepfather told her that she had urinated, but she did not believe him.

When her wisdom teeth were removed in January, she told police she remembers her stepfather trying to touch her. He later allegedly told her he had sex with her, she told police, and could not help himself. She said she went into her room and started cutting herself, telling him she wanted to kill herself. He allegedly told her that if she told anyone, he would kill himself and her 4-year-old stepbrother and 3-year-old stepsister would not have a father.

She told police she tried telling her mother what happened, but her mother told her that since she did not remember what happened, she must be lying. She said that she did not tell anyone else about it because she knew what it was like to grow up without a father and did not want that for her stepbrother and stepsister.

She said that several times her stepfather had given her medicine or pills that would impair her memory or make her pass out. After he awoke he would tell her he had sex with her, most recently in February.

A couple weeks before the night of March 23, she said her stepfather had allegedly told her he wanted to have sex with one of her friends. She said she told him to have sex with her mother, and he allegedly responded: “She’s not young enough.”

Police said the man was uncooperative while being search and they found a plastic straw containing a white powdery substance and a metal container containing 15 milligram oxycodone pills on his person. Oxycodone is a opiate pharmaceutical, found in brand name drugs like Oxycontin, according to drugs.com.

Police also found in his master bedroom three tinfoil wrappers containing marijuana and an unidentified white, powdery substance.

The man’s next expected court date is March 28.
