Longtime prosecutor to challenge Waukesha County judicial appointee

Waukesha - Even before Gov. Jim Doyle's appointee as Waukesha County circuit court takes a seat on the bench in August, an unsuccessful applicant for the appointment has announced he'll run for election to the post in April.

Assistant District Attorney Lloyd Carter of New Berlin filed his declaration of candidacy Wednesday.

Kathleen Stilling of Brookfield, a private practice attorney and former public defender, was picked from seven applicants to fill the vacancy created with the resignation of Judge Paul Reilly, who was elected to the District 2 Appeals Court bench effective Aug.1.

Carter was one of three assistant district attorneys - two from Waukesha County and one from Milwaukee County - who sought the appointment, along with an assistant attorney general and three private practice attorneys.

According to his announcement, Carter already has the endorsement of his boss, District Attorney Brad Schimel, who complained in a Waukesha Freeman article after Stilling's appointment that his assistants had been passed over for appointments by Doyle in recent years. Several former prosecutors currently serve on the Waukesha County bench, however.

Carter has been a criminal prosecutor in the Waukesha County District Attorney's office for about 22 years.

Doyle's last Waukesha County judicial appointee, Richard Congdon, was defeated in his first election bid in April by state Rep. Mark Gundrum, whose term begins Aug. 1.
