Waukesha man charged with 13 counts of child pornography in Waukesha County Court Monday

A 21-year-old Waukesha man who used the Internet site, Skout.com, to allegedly sexual assault a 13-year old boy was in court Monday on child pornography charges.

Daniel R. Schmidt was charged on separate charges of 13 counts of possession of child pornography from March 23.

He was to appear at the Waukesha County Courthouse this afternoon with a preliminary hearing set for 10 a.m. Aug. 2.

He was also appearing in court for two charges of drug trafficking and one charge on the intent to deliver methamphetamine last fall.

Schmidt was also charged June 5 with sexually assaulting a 13-year-old Muskego boy he met on Skout.com, a mobile flirting website.

According to the criminal complaint, Schmidt and the victim went to Hales Corners Park where a woman noticed them engaging in sexual conduct and called police.

Schmidt was posing as a 16 year old to enter the under-18 group. Skout.com has since shut down its under-18 portion.

This was the latest run-in with the law for Schmidt as City of Waukesha Police Department officers were involved in drug investigations relating to Schmidt when he became involved in a high speed pursuit in March.

Schmidt consented to officers viewing his cell phone. Detective Michael Carpenter said that while looking through the messages, it appeared Schmidt was having conversations with a 14-year-old male.

In the messages, Schmidt discussed having sexual intercourse with the boy. Carpenter also notes Schmidt was speaking with another juvenile about exchanging pictures of their genitals, according to the report.

Carpenter indicated that in some of Schmidt’s text messages, Schmidt told another individual, “OMG I had to bring my laptop over and I have so much kid porn it’s ridiculous.”

The individual replied, "if you get caught you're done for, you'll be a sex predator." The complaint then says Schmidt replied, "I won't get caught, my computer is untraceable, plus it's all saved on a separate hard drive."

According to the criminal complaint, Schmidt lives with his mother and father at 1903 Tallgrass Circle, Waukesha.

The defendant stated on March 23 that about a month earlier, he went online and found himself mainly attracted to 12-to 14-year-old boys. He said he downloaded about 75 pictures of 10-to 14-year-olds and about 10 videos of 10-to 14-year-olds.

According to the report, the videos consisted of boys masturbating and performing oral and anal sex. The defendant also said he viewed the webcam of 10-to 14-year-old boys and they would masturbate while he watched and then Schmidt would let them watch while he masturbated.

The defendant stated he shared about 360 pictures and four videos of the 10-to 14-year-old boys that he obtained by trading.

Schmidt said all the pictures and videos of the 10-to 14-year-old boys were downloaded over a month and a half span earlier this year.

In the complaint, Carpenter said he did a forensic analysis of Schmidt’s cellphone along with the hard drive in Schmidt’s computer.

In addition to finding two boys engaging in sexual intercourse on Schmidt’s cellphone, Carpenter found 630 images and videos, the majority of them depicting child pornography, on the defendant’s computer hard drive.
