Mining Bill on Today’s Senate Calendar

Assembly Bill (AB) 426, the mining bill, is on the calendar for today’s Senate floor session.  Yesterday, the Legislature’s Joint Committee on Finance adopted modifications to the bill.  Those modifications may be found here.

Among other things, the Joint Finance modifications would:

  • Delete the bill’s provision requiring automatic DNR approval upon DNR exceeding 360 days to review a permit application.
  • Extend the bill’s 360 day permit review period to 420 days and provide an additional 60 day review extension in certain situations.
  • Restore a contested case hearing to the permitting process.

These changes represent a good faith effort to compromise provisions in AB 426.
